Members: Submit VAI’s comments today on FAA’s new drone rule

Right-of-way rules must protect low-altitude crewed operations under Part 108.

We are urging our members to submit VAI’s updated comments to the FAA on the proposed Part 108 beyond visual line of sight (BVLOS) drone rule by this Wednesday, Feb. 11. The FAA reopened the comment period for a short window, and this round focuses on one issue that drives low-altitude safety risk: right-of-way. These decisions will set the baseline for how drones and crewed aircraft share the airspace where vertical flight operates every day.

VAI is urging the FAA to keep established right-of-way rules as the governing baseline for crewed aircraft and to protect the least maneuverable aircraft in shared low-altitude airspace. The final rule should not shift risk onto helicopter crews through “see and avoid” assumptions when small unmanned aircraft systems operate beyond visual line of sight. Right-of-way must be clear, practical, and enforceable for BVLOS operations.
